OTTAWA -(Dow Jones)- A NAFTA Tribunal has
awarded Pope & Talbot Inc. $ 461,566 in damages and interest in connection with the
tribunal's ruling that administrative actions taken by Canada violated NAFTA investment
rules. The Canadian government announced the damage award in a news release Friday. As reported, in April 2001 the NAFTA tribunal rejected most of the claims that Pope & Talbot brought against Canada under NAFTA's Chapter 11. The forest- products company had sought damages over softwood lumber export limits imposed by Canada under the Canada -U.S. softwood lumber pact of 1996. However, the tribunal found in Pope & Talbot's favor in one instance - it ruled that Canada , in asking Pope & Talbot to ship documents up from Oregon in the course of a quota audit, rather than visiting its head office to examine them, had failed to meet a minimum standard of treatment. If the company had been based in Canada , the documents would have been inspected on site. The NAFTA panel took issue with what it saw as setting one standard for domestic companies and another for foreign companies.
